On August 15, 2022, Fernandez was arrested by police in Raleigh, North Carolina and charged with Child Abuse Causing Serious Bodily Injury. He was booked into the Wake County Jail.
However, since taking office in 2018, then-Sheriff Gerald M. Baker refused to cooperate with U.S. Immigration and Customs Enforcement (ICE), the dangerous illegal alien was allowed to simply bond out.
He is currently being held once again in the Wake County Jail on a mere $5,000 bail, and though the county has a new sheriff (Willie Rowe), illegal aliens still have a get-out-of-jail-free card in Wake County. Despite the serious nature of his crimes and his status in this country, Fernandez will undoubtedly soon be released back onto the streets of Raleigh, North Carolina.
