Previously Deported Sex Offender Freed By Va. Judge, Arrested By ICE

CHARLOTTESVILLE, Va. - On September 25, U.S. Immigration and Customs Enforcement (ICE) agents arrested David Ambrosio-Herrera, 36. The Mexican national has a long criminal history in this country, including multiple sex crimes against children. He has also entered the United States illegally at least three times.
In a press release, ICE acting Field Office Director Joseph Simon, stated:Â
David Ambrosio Herrera is a serial criminal illegal alien and a convicted child sex offender. He is exactly the kind of person we aim to remove from the United States. He has illegally reentered the country multiple times, has prior criminal convictions and should have never been here to traumatize this child. ICE Washington D.C. will continue to prioritize public safety by arresting and removing criminal alien threats from our Washington D.C. and Virginia neighborhoods.
What follows is a brief history of some of Ambrosio-Herrera’s crimes in this country:
-On April 2, 2007, he was caught crossing the border illegally, and returned to Mexico. However, three days later, he was again caught entering illegally.
-On July 7, 2014, Ambrosio-Herrera was arrested by Charlottesville police, who charged him with identity theft: possessing a fictitious ID card. He was convicted and sentenced to 30 days in jail.Â
-On January 31, 2017, police in Albemarle County arrested the Mexican national and charged him with five counts of perjury: falsely subscribing a written declaration. An ICE hold was issued at this time.Â
-On May 15, 2024, an immigration judge ordered Ambrosio-Herrera be removed from the United States to Mexico.Â
-On October 25, 2024, he was arrested by the Albemarle County Police Department and charged with indecent liberties with a child under fifteen years old. He was convicted on September 25, 2025, and sentenced to six years in prison. The court then suspended all six years of Ambrosio-Herrera’s prison sentence.
Fortunately, ICE agents were waiting outside the courthouse as Ambrosio-Herrera exited and tried to flee. Following a brief foot chase he was apprehended and is now in ICE custody pending his deportation.
This case demonstrated how illegal aliens have been assisted in their crimes against Americans at every level of government. Why would a judge allow a previously deported sex offender to simply walk out of his courtroom back onto the streets?Â
Unfortunately, the American people do not have a high-powered lobby with deep pockets to bribe public officials the way the drug cartels and open-border lobby groups do.
