On January 16, 2022, Marcial-Pineda was arrested by deputies in Franklin County, and charged with 15 counts of sexual exploitation of a minor. He was booked into the Franklin County Detention Center on $250,000 bail.
Following that arrest, in a news release, the Franklin County Sheriff's Office stated:
Charges stemmed from an extensive investigation conducted by Franklin County Sheriff’s Office Internet Crimes Against Children Task Force and the North Carolina State Bureau of Investigations Computer Crimes Unit.
At this time, the circumstances of Marcial-Pineda's release from the Franklin County Jail are not known.
Now, despite the serious nature of the charges against him and his history of crimes against children, Wake County Sheriff Gerald M. Baker will not honor an ICE detainer request filed against Marcial-Pineda.
Since taking office on December 3, 2018, Sheriff Baker has refused to cooperate with U.S.Immigration and Customs Enforcement, and has released many dangerous criminals back into his county, despite ICE detainers being issued against them.
