WATFORD, ND - On April 12, police arrested Julian Castro Montoya, 19, days after he reportedly ran over a 6-year-old boy in the parking lot of an apartment complex. Not only did he make no attempt to avoid hitting the boy, but also ran from the scene, according to witnesses.
Shortly before 7:00 p.m.,police arrived at 1218 Main Street N, only to find the little boy dead next to his bicycle.
Investigators on the scene observed black tire marks on the ground where Montoya was turning, indicating that he did not hit the brakes in his 2012 Toyota Tundra as he rounded the corner, and was traveling well in excess of the posted 10 mph speed limit, according to a police report.
It was determined that Montoya actually sped up and made no attempt to steer around the child.
The victim, Ian Matteo Garcia, was in the garage area of the parking lot, adjusting the seat on his bicycle when he was hit with such force, his tiny body was sent flying several feet.
Montoya was charged with vehicular manslaughter and driving without a license. He is currently being held at the McKenzie County Correctional Center on an ICE detainer.
If convicted, Montoya could receive up to five years in prison.
