Charge(s): Four Counts of Statutory Rape of a Child by an Adult (Victim 13-15), Four Counts of Indecent Liberties with a Child, Two Counts of Felony Child Abuse-Sexual Act and Sexual Battery
*On September 25, 2021, Cruz was arrested on several child sex assault warrants (involving two victims) from both Kannapolis (NC) and Rowan County. Shortly after his arrest, he was able to post bail, and despite his immigration status and the serious nature of the charges, he was released from the Rowan County Jail.
Of course, he did not show for his court date, and was listed as a fugitive by the N.C. State Bureau of Investigation.
A few days before Christmas, the suspect was arrested in New Orleans and placed in the the Jefferson Parish Jail, while he awaited extradition back to North Carolina.
Cruz has been transferred to the Rowan County Jail.
It is not known at this time if the Rowan County Sheriff's Office refused to enforce an ICE Hold, or if ICE refused to issue one, or failed to respond when being notified of Cruz's impending release.
Under the Biden administration, it has become increasingly commonplace for ICE to simply refuse to pick up criminal suspects and allow them to be released back onto the street.
